The BUYER shall construct a principal or secondary residence within three (3) years from the signing hereof.
This residence shall have a value of at least one hundred and fifty thousand dollars ($150,000.00) on the municipal assessment roll (hereinafter referred to as the said residence).
If the said residence is not constructed in accordance with the terms and conditions set forth herein within three (3) years from the anniversary date of the deed of sale, the SELLER shall issue the BUYER an invoice for a penalty of one thousand dollars ($1,000.00) as partial damages, payable on the first day of the thirty-seventh (37th) month following the anniversary date of the deed of sale, thereby granting the BUYER an additional period of one (1) year to construct the said residence.
If, after four (4) years from the anniversary date of the deed of sale, the said residence has still not been constructed, the SELLER may exercise either of the following two (2) options:
a) Exercise its right of resolution and retake full ownership of the sold immovable;
b) At its sole discretion, charge the BUYER a yearly penalty as partial damages until a residence is constructed in accordance with the conditions set forth herein, thereby granting the BUYER, each time, an additional period of one (1) year to complete the construction of the said residence. However, beginning in the fourth (4th) year, the amount of the penalty shall increase by two hundred and fifty dollars ($250.00) per year.
If any penalty amount is not paid when due, the SELLER shall not be required to honour the extension granted to the BUYER and may seek resolution of the sale in accordance with the applicable legal procedure.
In the event of a sale, gift or transfer of the immovable to a third party, the anniversary date used to determine the obligations set forth herein shall remain that of the original sale. Accordingly, if penalty invoices have begun to be issued, they shall continue according to the schedule and amounts provided above.
The above-mentioned conditions shall be reproduced as written in all subsequent deeds relating to the immovable that is the subject of these presents, for as long as the said residence has not been constructed on the immovable. The BUYER's heirs and successors shall be bound by these obligations.
BUYERS, PLEASE BE ADVISED that the broker, being bound by a brokerage contract with the SELLER, protects and promotes the interests of their client. The broker will provide you with fair treatment. You are also advised that you may choose to be represented by the licence holder of your choice.
